1. About us

The Site is operated by Crop Top LLC, a California limited liability company doing business as Pansy (“Pansy,” “we,” “us” or “our”).

2. Orders and payment

To place an order you must be legally capable of entering into a binding contract, and you must be authorized to use the payment method you provide.

Prices are quoted in U.S. Dollars. The price of each item, the applicable shipping charge and any taxes collected by Pansy are shown at checkout before payment is made. Pansy makes no charge for access to or use of the Site.

If you check out from outside the United States, our payment processor may show your order total, and charge you, in your local currency.

Our products are dyed in small batches, and there may be slight variation in color between batches. The colors of our products as displayed on your screen may also differ from the actual colors.

Your order constitutes an offer to us to buy a product. Any order confirmation e-mail we send is an acknowledgment of receipt only and does not constitute acceptance of your order. Acceptance of your order, and the formation of a contract of sale between Pansy and you for a product, will not take place unless and until we ship that product to you.

We may refuse or cancel any order prior to acceptance, including where (a) the product is out of stock; (b) there is an obvious error in the price or description of the product; or (c) we reasonably suspect that the order is fraudulent or that the payment method used is not authorized. If we cancel your order, we will notify you and promptly refund any sums you have paid for the cancelled products, including any related shipping charges and taxes.

3. Shipping and returns

Shipping rates and methods are set out at checkout and on our Questions page. If shipment is delayed, we will give you such notice, option to cancel and refund as applicable law requires.

If you order products for delivery outside the United States, your order may be subject to import duties and taxes which are levied when the delivery reaches the destination country. Pansy has no control over these charges, and unless they are collected at checkout, you will be responsible for paying them.

Our Returns Policy is incorporated into these Terms by reference. Returns other than of faulty, damaged or incorrect items are accepted only in accordance with the Returns Policy. If you receive a product that is faulty or damaged, or that is not the product you ordered, please contact us. This does not affect your statutory rights.

Customers to whom EU or UK consumer law applies should note that we are under a legal duty to supply goods that are in conformity with this contract, and that their statutory right to cancel, and their rights in respect of faulty, damaged or misdescribed goods, are unaffected by these Terms and by our Returns Policy.

4. Website use and privacy

Pansy (or its licensors, where applicable) owns the copyright and all other intellectual property rights in the Site and in the material published on it. You may view the Site and use it for lawful shopping and informational purposes. Unless the law permits otherwise, no part of the Site may be copied, reproduced, distributed or modified, and none of the material on it may be used for commercial purposes, without our permission.

You agree not to use the Site for any unlawful purpose and not to attempt to gain unauthorized access to it or to any server or system connected to it. You also agree not to do anything which interferes with the proper working of the Site.

Our Privacy Policy explains what personal information we collect and how we use it.

5. General

These Terms shall be governed by and construed in accordance with the laws of the State of California. As a consumer, you will also benefit from any mandatory provisions of the law of the country or state in which you live.

We may change these Terms from time to time. Any change takes effect when the revised Terms are posted on the Site and does not apply to orders placed before then. Every time you order products from us, the Terms and Returns Policy in force at that time will apply to the contract between you and us.

Pansy’s failure to insist on strict performance of any provision of these Terms is not a waiver of that provision or of Pansy’s right to enforce it at a later time. Should any provision of these Terms be found unenforceable, the remaining provisions shall not be affected.
